Humane Solutions to Restore Asylum Are Staring the Biden Admin in the Face. Failing to Act Now Puts Children in Harm’s Way.

Washington D.C.— Following a ruling last month from a federal judge that ordered the Biden administration to end the Title 42 policy, the administration announced today that it will appeal the court ruling. As it stands, the Biden administration will still be required to stop expelling migrants under the Title 42 policy by December 21st, but its appeal signals its continued defense of the anti-immigrant policy that began under the Trump administration, has been expanded under President Biden, and has resulted in millions of expulsions of migrants, returning them to harm and danger. 

Abena Hutchful, Policy & Litigation Attorney at the Young Center for Immigrant Children’s Rights, said: 

"With today’s appeal, the Biden administration once again has chosen to shamefully defend a deadly anti-asylum policy that has forced thousands of families to separate and wait in danger. If the Biden administration is truly committed to fair processes for people seeking safety at the border –as it has promised–– it must abandon all efforts to continue defending the horrors of Title 42 and follow through on urgent plans to welcome asylum seekers safely and with humanity. 

The solutions to create a fair system that treats immigrant children and all people arriving at the border with dignity and respect exist; the Young Center and our allies have been proposing them for years. Together we have proposed plans for more humane reception centers at the border, initiatives to evaluate family relationships at the border and keep loved ones together, and solutions to connect children, families, and adults to culturally inclusive and trauma-informed resources, including access to legal counsel to help them navigate their asylum cases once in the US. The Biden administration must have the courage to act with humanity and do what is right by restoring access to seek asylum and protecting immigrant families.”
